Welcome to TwoDots. These Terms of Service ("Terms") govern your access to and use of the TwoDots mobile application, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, downloading our app, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization (such as a squash club), you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

To use TwoDots, you must:

  • Be at least 13 years of age (or the minimum age in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information

If you are between 13 and 18 years old, you must have your parent or guardian's permission to use the Service, and they must agree to these Terms on your behalf.

3. Account Registration

3.1 Account Creation

To access most features of the Service, you must create an account. You may register using your email address or through third-party authentication providers (Google, Apple, Facebook).

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use

We reserve the right to disable any account if we reasonably believe you have violated these Terms.

3.3 Account Information

You agree to:

  • Provide accurate, current, and complete information during registration
  • Update your information to keep it accurate and complete
  • Not use another person's account without permission
  • Not create multiple accounts for deceptive purposes

4. The Service

4.1 Service Description

TwoDots is a squash analytics and tournament management platform that enables you to:

  • Log and track match results and statistics
  • View player rankings and leaderboards
  • Create and manage tournaments (single elimination, double elimination, round robin, Monrad, plate, and ladder formats)
  • Discover squash courts and venues
  • Connect with other players through social features
  • Share match results and achievements
  • Analyze your performance over time

4.2 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

4.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation.

5. User Content

5.1 Your Content

You retain ownership of content you create and upload to the Service ("User Content"), including match data, photos, comments, and profile information.

5.2 License Grant

By submitting User Content, you grant TwoDots a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display your User Content in connection with operating and improving the Service.

5.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate any third-party rights
  • Your User Content complies with these Terms and applicable laws

5.4 Content Removal

We may remove or disable access to any User Content that violates these Terms or that we find objectionable, without prior notice and at our sole discretion.

6. Acceptable Use

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

6.2 Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Harass, bully, threaten, or intimidate other users
  • Post hate speech, discriminatory content, or offensive material
  • Spam, advertise, or solicit without authorization
  • Manipulate rankings, statistics, or leaderboards through false data
  • Log matches that did not occur or with incorrect scores
  • Create fake accounts or use bots
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for competitive intelligence against TwoDots
  • Scrape or collect data from the Service without permission

6.3 Match Data Integrity

To maintain fair and accurate statistics, you agree to:

  • Only log matches that actually occurred
  • Record scores accurately and honestly
  • Not collude with others to manipulate rankings
  • Report any suspicious activity or data manipulation

7. Tournament Features

7.1 Tournament Creation

Users may create and manage tournaments subject to these Terms. Tournament organizers are responsible for:

  • Ensuring fair and transparent tournament rules
  • Accurately recording results
  • Managing participant communications
  • Complying with any applicable venue or federation rules

7.2 Tournament Participation

By participating in tournaments, you agree to:

  • Follow tournament rules and schedules
  • Accept recorded results unless there is a clear error
  • Behave respectfully toward organizers and other participants
  • Understand that TwoDots is not responsible for tournament disputes

8. Premium Features and Payments

8.1 Free and Premium Tiers

TwoDots offers both free and premium subscription tiers. Premium features may include advanced analytics, data export, priority support, and additional functionality.

8.2 Subscriptions

Premium subscriptions are billed on a recurring basis (monthly or annually). Subscriptions automatically renew unless cancelled before the renewal date.

8.3 Payment Terms

  • Payments are processed through Apple App Store, Google Play Store, or our web payment provider
  • All fees are non-refundable except as required by law or stated in our refund policy
  • We may change subscription prices with advance notice
  • You are responsible for all applicable taxes

8.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to premium features until then.

9. Intellectual Property

9.1 TwoDots IP

The Service, including its design, features, content, and trademarks, is owned by TwoDots and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9.2 TwoDots Name and Logo Origin

The "TwoDots" name and logo are original creations inspired by and derived from the sport of squash. The logo represents the two distinctive yellow dots found on a double-yellow-dot squash ball—the official ball used in professional squash competitions worldwide. The double-yellow-dot ball is recognized as the standard for competitive play, symbolizing the highest level of the sport.

The TwoDots brand identity, including the name, logo design, color schemes, and visual representation of the two dots, is the exclusive intellectual property of TwoDots. This original concept was independently created to reflect our connection to and passion for the sport of squash. Any similarity to other marks is purely coincidental and unintentional.

We assert that the TwoDots name and logo are our original works, created without reference to or derivation from any third-party trademarks, brands, or intellectual property. The conceptual basis for our brand is solely the universally recognized double-yellow-dot squash ball used in the sport we serve.

9.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by TwoDots without any obligation to you.

10. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Third-Party Services

The Service may integrate with or link to third-party services (social media, maps, payment processors). Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party services.

12. Disclaimers

12.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

12.2 No Guarantees

We do not guarantee that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Results from the Service will be accurate or reliable
  • Any errors will be corrected

12.3 External Content

We are not responsible for the accuracy of user-generated content, including match scores, statistics, rankings, or venue information.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWODOTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless TwoDots and its affiliates from any claims, damages, losses, and expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

15. Termination

15.1 Termination by You

You may terminate your account at any time by deleting it through the app settings or by visiting our Contact page.

15.2 Termination by TwoDots

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

15.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and User Content
  • Provisions of these Terms that should survive termination will remain in effect

16. Dispute Resolution

16.1 Informal Resolution

Before filing a formal dispute, you agree to contact us through our Contact page to attempt to resolve the dispute informally.

16.2 Governing Law

These Terms shall be governed by the laws of the country in which you reside. For users in the European Economic Area (EEA), UK, or Switzerland, the laws of your country of residence shall apply. For users in Australia, Australian law shall apply. For users in the United States or Canada, the laws of the state or province where you reside shall apply. For all other users, these Terms shall be governed by the laws of England and Wales.

16.3 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by a recognized arbitration institution in your jurisdiction, or through the courts of competent jurisdiction in your country of residence. Either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement of intellectual property rights.

16.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS AND WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and TwoDots.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms or your rights without our written consent. We may assign these Terms without restriction.

17.5 Notices

We may provide notices to you via email, in-app notification, or by posting on the Service. You may contact us through our Contact page.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. For significant changes, we may also notify you via email or in-app notification.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
